--A Mitchell man received a twoyear prison sentence Tuesday for making fraudulent Medicaid claims while he was the owner of a local rehabilitation facility.

Kim Reid, 55, was sentenced by Judge Tim Bjorkman to five years in the state penitentiary. Bjorkman suspended three years. Reid will be eligible for parole in July 2011.

Reid will be required to pay a $5,000 fine, prosecution costs of $1,485.58, court costs of $104 and the remaining $55,000 in restitution. Reid has already paid back $60,000 in restitution to the state Department of Social Services and the state Department of Human Services.

As Bjorkman issued his sentence at the Davison County Omega Seamaster 007 OM-19 Safety Center in Mitchell, at least two members of Reid's family broke out in tears.

Reid, who owned LifeLight Counseling with his wife, Elaine, has surrendered his drug and alcohol counseling certificate. The accreditation for LifeLight Counseling, which has since been sold to Abbott House, has been revoked by the state.

"We will investigate and hold accountable those who cheat South Dakota taxpayers by committing Medicaid fraud," Attorney General Marty Jackley said in a news release about the sentencing Tuesday.

Reid pleaded guilty earlier this year to making false Medicaid claims. He Omega Seamaster Americas Cup OM-49 to having clients sign their names to roster sheets either too long after counseling sessions took place or, in some cases, for sessions the clients had never attended.

Reid's lawyer, Doug Dailey, asked Bjorkman to fashion a sentence without prison time, claiming Reid's crimes were a result of "mismanagement of his own business."

He also noted that the minority of the claims were made for services not actually rendered.

"He just got to a point in his life where he was dealing with too much and kind of stuck his head in the sand with regard to management," Dailey said. "Everything got out of hand."

Dailey entered three letters of support for Reid and copies of Omega Seamaster Automatic OM-37 letters written by Reid as evidence.

While prosecuting attorney Paul Kramer agreed with much of Dailey's assessment, he said intentional fraud was committed by Reid and a prison sentence is therefore in order.

Kramer also praised the unnamed employee who first alerted authorities to Reid's fraudulent practices.

During sentencing, Bjorkman acknowledged that most of the claims made by Reid were actually for services rendered, although the paperwork was filled out Omega Seamaster Co-Axial OM-11 since many of the signatures were obtained after the services were rendered.

He also called fraud an "insidious practice" and acknowledged a prior felony conviction for theft by deception from 25 years ago.

"If anyone on the planet should understand the benefit of taking full responsibility for your actions, it's a drug and alcohol counselor," Bjorkman said.

The conviction was a sharp turn for Reid, who only one year ago was helping to set up a support group for prison inmates.

Before sentencing, Reid expressed remorse for his Omega Seamaster Co-Axial OM-58 and for the emotional damage it has caused those closest to him.

"I've got a lifetime of apologies," he said.

Former Ojai resident Dominique Pearl David on Tuesday survived the elimination challenge on the debut of "The Fashion Show: Ultimate Collection" on Bravo, earning praise from judge Isaac Mizrahi and, off screen, some words of advice from another reality-TV star with ties to Ventura County.

David, a 2007 graduate of Nordhoff High School, is one of 12 fashion designers who are competing for the grand prize of $125,000 and a fashion spread in the pages of Harper's Bazaar. The reality-show competition, which also features Somalia-born model-turned-businesswoman Iman as a judge and Omega Railmaster Mechanical OM-52, airs at 10 p.m. Tuesdays.

During the second-season premiere, David, 21, joined five other designers to create a collection inspired by Iman, one of the first black supermodels.

Dubbed House of Nami, David's team won the challenge with a collection that focused on white and black pieces. David's contribution, a sleeveless shift with a thin stripe of red at the waist, was praised by Mizrahi, a designer who is as well known for his outspokenness as he is for his clothing.

"(It's) really great and modern," Mizrahi said of David's design. "(It's) a chic little dress you Omega SeaMaster - James Bond Agent 007 OM-34 wear at night" or during the day.

Such words were confirmation that "maybe I'm not out of my league," David said in a phone call from New York, where she is now living. "It was kind of a confidence boost, especially since so many of the other designers on the show have more industry experience than I do."

That confidence is key to staying in the competition, said Fabio Viviani, who had just opened Cafe Firenze in Moorpark when he starred on Bravo's "Top Chef New York." He will return to the network when "Top Chef All-Stars" debuts on Dec. 1.

"In my case it was a food competition, but it's still a TV show. It's brain Omega Seamaster 007 Edition OM-57," Viviani said of the experience of taping a reality-competition program. "She should never forget that, even if she don't have a great day, the important thing is, don't have the worst day and get sent home."

Lindsey and Tony Moceri are opening their second Fairhaven hair salon, Karibou, at 1201 11th St., Suite 101.

They also own Salon Bellissima, a full-service salon and spa at 1215 Old Fairhaven Parkway.

Karibou will have six styling stations, all on wheels. The Omega Seamaster 007 OM-17 are mobile so the space can be easily cleared out and used as an art studio and to host such events as fashion shows featuring items from local boutiques and clothing designers, according to a company news release.

The new salon is scheduled to open Friday, Nov. 12. A grand opening celebration is scheduled for Nov. 12-13, with all services 50 percent off those two days.

Walk-ins are welcome. Once open, the salon's hours will be 10 a.m. to 8 p.m. Tuesday through Saturday.

Lindsey Moceri said the reason for opening a second Fairhaven salon is because they really Omega Seamaster 007 OM-18 the 11th Street spot when it became available, and they want to attract people interested in art. Karibou will be a high-end boutique salon, but will feel more like an art studio, she said.

Macy's, Inc. has reported total sales of $1.807 billion for the four weeks ended Oct. 30, an increase of 6.8 percent compared with total sales of $1.693 billion in the four weeks ended Oct. 31, 2009.

In a release on November 4, Macy's, Inc. said that sales were up 2.5 percent in October on a same-store basis.

"While we experienced some softness in sales early in October given the Omega Omegamania Lady Watch OM-84 warm weather, we ended the month with a strong trend going into the holiday selling season. Customers have reacted positively to the launch of our unique holiday gift-giving merchandise and newness in fashion. We also launched our latest exclusive brand relationship with Kenneth Cole Reaction men's sportswear, now sold only at Macy's. Overall, we are pleased with our sales performance in the third quarter and the continued results of major strategies including our My Macy's localization initiative. Bloomingdale's sales continued to be strong in October and the third quarter," said Terry J. Lundgren, chairman, president and chief executive officer of Macy's, Inc. "Our repurchase of another $500 million of debt in the third quarter reflects our strong cash position, as well as our confidence about the strength of the business going forward."

For the third quarter of 2010, the company's total sales were $5.624 billion, an Omega Omegamania Lady Watch OM-85 of 6.6 percent compared with total sales of $5.277 billion in the same 13-week period last year. On a same-store basis, Macy's, Inc.'s third-quarter sales were up 3.9 percent.

For the year to date, Macy's, Inc. sales totaled $16.735 billion, up 7.0 percent from total sales of $15.640 billion in the first 39 weeks of 2009. On a same-store basis, Macy's, Inc.'s year-to-date sales were up 4.7 percent.

Online sales were up 19.7 percent in October, 24.0 percent in the third quarter and 28.5 percent in 2010 year-to-date. Online sales positively affected the company's same-store sales by 0.8 percentage points in the third quarter and 0.7 percentage points in the year to date. Online sales are Omega RailMaster Mechanical OM-44 in the same-store sales calculation for Macy's, Inc.

Updated Guidance

The company's guidance is for same-store sales in the fourth quarter of 2010 to be up 3 percent to 4 percent. This translates to same-store sales for the second half of 2010 to be up 3.3 percent to 4 percent, compared with previous guidance (provided in August 2010) of up 3 percent to 3.5 percent.

Based on stronger sales expectations, Macy's, Inc. is increasing its earnings guidance for the second half of 2010 to $1.50 to $1.55 per diluted share, excluding expenses associated with the early retirement of debt in the third quarter. This compares with previous guidance (provided in Omega RailMaster Mechanical OM-45 2010) of $1.45 to $1.50 per diluted share for the second half of 2010.

The company also reported it used excess cash to repurchase $500 million face value of Senior Notes and Debentures in the third quarter. The repurchases, which were made in the open market, included debt with maturity dates from 2011 through 2016.

Total cost of the repurchases was approximately $541 million, including expenses related to the transactions. As a result of this repurchase, Macy's, Inc. has booked approximately $39 million (approximately $24 million after tax; 6 cents per diluted share) of expense associated with the early retirement of debt in the third quarter of 2010 in interest expense. This will be partially offset by approximately $7 million in reduced net interest expense in the fourth quarter of 2010. In addition, the company expects net interest expense to be reduced by Omega RailMaster Mechanical OM-51 $26 million in fiscal 2011 as a result of repurchases made in the third quarter.

In total, the company has reduced its debt by more than $1.2 billion in fiscal 2010. The reduction includes $500 million in debt repurchased in each of the first and third quarters, as well as $150 million in Senior Debentures retired at maturity on November 1, and $76 million in Senior Notes retired at maturity on June 1.
